Trade Terms
These Trade Terms govern all sales by Blume Distributions (Pty) Ltd ("the Company", "we", "us") to professional salon customers ("the Buyer", "you") in South Africa.
This page sets out three policies that apply to your trade account with us:
- Terms and Conditions of Sale — the general terms governing every order
- Returns and Refunds Policy — how we handle breakages, shortages, and faulty goods
- Shipping Policy — delivery areas, fees, lead times, and risk
Terms and Conditions of Sale
1. Scope
The Company sells professional haircare products on a wholesale basis to licensed salon professionals only. We do not sell directly to members of the public.
2. Orders
Orders are placed via your assigned sales representative, by telephone on 010 157 0760, or by email to admin@blumebrands.co. The Company reserves the right to accept or decline any order at its discretion.
3. Prices
- All prices are quoted exclusive of VAT unless stated otherwise. VAT is levied at the prevailing rate.
- Prices are subject to change without prior notice in response to supplier or currency adjustments.
- Orders below R2,000 (VAT incl.) delivered by courier incur a delivery fee of R140.
4. Payment
- Payment terms are Cash on Delivery (C.O.D.) unless an account with credit terms has been approved in writing.
- No order will be accepted or processed while an account is in arrears.
- Interest on overdue amounts is charged at prime plus 2% per annum, calculated monthly.
5. Title to Goods
Blume Distributions (Pty) Ltd retains title to the products until all amounts due from the Buyer are paid in full. In the event of the Buyer being unable to pay its debts, including by virtue of liquidation, business rescue, or bankruptcy, the Company may enter the Buyer's premises and recover the products that remain its property. The Buyer grants the Company an irrevocable licence for this purpose.
6. Delivery and Risk
- Delivery of products is the responsibility of the Company.
- Risk in the products passes to the Buyer upon delivery.
- Upon receipt the Buyer must check that the stock received matches the invoice and inspect for any damage to packaging.
- If no written notice is received within five working days of delivery, the products are deemed accepted as being in good order.
7. Substitutions
For any valid claim by the Buyer, the Company reserves the right to deliver products in substitution.
8. Limitation of Liability
The Company's liability is limited to replacement or credit of defective products to the value of the original invoice. The Company shall not be liable for any indirect, consequential, or special losses including loss of profit or business interruption.
9. Force Majeure
The Company is not liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to supply chain disruption, courier failure, load shedding, or acts of government.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa and the parties consent to the jurisdiction of the South African courts.
Returns and Refunds Policy
Scope
This policy governs returns and credits for goods supplied to our trade customers.
Breakages and Shortages
- You must notify our office of any breakages or shortages within five working days of receipt of order.
- No claims will be accepted if submitted more than five working days after delivery.
- For breakages or damaged goods, you must submit a clear photograph of the affected items to your sales representative. The representative will forward the image to our office for assessment and authorisation.
- Only authorised returns will be accepted.
Faulty Products
Where a product is confirmed faulty, we will at our discretion either replace the product or issue a credit to your trade account.
Invalid Claims
Invalid claims will incur a 20% surcharge.
Refunds
As we trade on a wholesale basis with professional salons, cash refunds are not generally provided. Approved returns are processed as credits against your trade account and applied to future orders or your outstanding balance.
Returns Not Accepted
We do not accept returns of:
- Products ordered correctly and supplied in good condition
- Products that have been opened, used, or tampered with
- Products outside the five working day claims window
- Promotional or sample products
Shipping Policy
Delivery Areas
We deliver to professional salon customers throughout South Africa.
Couriers
Deliveries are made via our nominated courier partners, currently Courier Guy and Buffalo Couriers.
Delivery Fees
- Orders R2,000 and above (VAT incl.): free standard delivery.
- Orders below R2,000 (VAT incl.): R140 delivery fee.
Delivery Times
Indicative lead times from order confirmation:
- Gauteng: 1–3 working days
- Other major centres: 3–5 working days
- Outlying areas: 5–7 working days
Risk and Inspection
Risk in the products passes to you on delivery. You must inspect the goods within five working days of receipt and notify us in writing of any damage or shortage within that period. Refer to our Returns and Refunds Policy above.
